What we need
Kwil Legal Services Limited will be what is known as the ‘Controller’ of the personal data you provide to us. This data includes all basic information you have provided, including name (current and previous), address (current and previous), telephone number, email address, date of birth, etc. This also includes the details of any financial business you have identified as having been sold a financial product or products by, which you wish to investigate for mis-sale and/ or incorrect advice, and (provided either by you or said financial businesses) the details of those products.
Why we need this data
Kwil Legal Services Limited requires this data, firstly to verify your consent to act on your behalf as Claims Management Company and approach the financial businesses you have identified. Secondly, it is necessary to be able to locate and access the required historic financial data with said businesses. Finally, it forms the basis of the complaint(s) being made on your behalf for claiming redress, on your behalf.
This consent, ‘contractual obligation’ and ‘legitimate business interest’ form Kwil Legal Services Limited’s legal basis for processing your personal data.
What we will do with your data
The data you provide will be shared with the financial businesses you have identified as wishing to investigate. If necessary, it may also be provided to intermediary or regulatory bodies, such as The Financial Ombudsman Service or The Financial Services Compensation Scheme, if a mis-selling complaint cannot be resolved directly with said financial business.
Your information may be stored on a cloud-based system whose servers are located within the European Union.
We take all reasonable steps to ensure that your personal data is processed securely.
How long we will keep your data
Kwil Legal Services Limited is conscious to ensure that we respect our clients’ right to be ‘forgotten’, and to this end we aim to keep your data for no longer than necessary. Due to regulatory requirements, Kwil Legal Services Limited will keep client data for a period of six years from the completion of our contract or closure of a client record, or at the point the business closes, whichever occurs first.

Kwil Legal Services Limited will be what is known as the ‘Controller’ of the personal data you provide to us. Unless otherwise agreed with you, we will only collect basic personal data about you, which does not include any special categories of personal information about you (often known as ‘sensitive personal data’). This information does, however, include the likes of your name, home address, email address, telephone number and other details relating to your mortgage overpayment query that were provided to us by you.
Why we need this data
We need to know basic personal data in order to provide you with the mortgage auditing services you have engaged us to provide. If you do not provide this information, then we will be unable to provide the auditing services you have requested. We will not collect any personal data from you that we do not need in order to provide and oversee the services we have agreed to provide you with.

What we will do with your data
All the personal data we hold about you will be processed by our staff in the United Kingdom. Data will be shared with the financial business(s) you have identified within this application, in order to obtain financial records that will permit a review of potential claims. The information that is relevant to your payment of undisclosed PPI commission, that was provided to us by you and the provider(s), lender(s), or institution(s), may be passed to Our Partners.
This information is passed to Our Partners (who act as a Joint Data Controller), and their Auditing Partner (who act as a Data Processor for Our Partners), with the purpose of identifying potential claims.
Our Partners are responsible for assessing your information and the merits of your claim. We are not part of this process, nor do we monitor it. Our partners decide whether to pass your case on to the solicitors on the basis of their own opinion.
Should a claim be located, you will be given the option to sign a Conditional Fee Agreement (CFA) with a solicitor’s firm. Your Personal Data will not be shared with this solicitor’s firm, until you sign said CFA (and if choose not to sign the CFA, your data will never be passed to the firm). Once signed, your case will be taken on, and said firm will become the Data Controller.
The full Data Protection policies of Our Partners; Dolfin Tech Ltd (whom are based in the UK and registered in England & Wales #12082317), and their Auditing Partners; Audit Partners Ltd (whom are based in the UK and registered in England & Wales # 10887243) can be provided upon request or by writing to, Data Protection Officer at the registered address of each partner. The solicitor’s Data Protection Policy will be made available to you in the event that your case is to be passed on to them, and this will not be done without consent.
